The Burial and Cremation Regulations 2015

The Burial and Cremation Regulations 2015 took effect on 22 May 2015.

The remade Regulations combine the Burial and Cremation (Handling of Human Remains) Regulations 2005, the Burial and Cremation (Cemetery) Regulations 2005 and the Burial and Cremation (Cremation) Regulations 2012.

The Regulations include a number of minor amendments.  Information about the changes made in the Regulations are provided for your information.

One notable change made to the Regulations was providing greater flexibility for the completion of a Declaration of Life Extinct (DoLE) form.  The Regulations now provide for the Director of Local Government to approve two formats of the DoLE form.

Regulation 10(2)(a) and 10(2)(b). Regulation 10(2)(a) provides for the Director to approve DoLE form 1 that can be completed by a medical practitioner under Regulation 7(1)(b) or a responsible person under Regulation 9(1)(a) when they attend a place of death.

Regulation 10(2)(b) provides for the Director to approve DoLE form 2 that can be partially completed by a nurse, or an officer of the Ambulance Service that attends a place of death under Regulation 9(3) and completed by a police officer, midwife, nurse or ambulance officer under Regulation 9(5).

The regulations support the Burial and Cremation Act 2002 in which further information is available on the legislation including the requirements for completion of the 'Declaration of Life Extinct' forms and the requirements for the use of identification tags.
